Does it matter that Zimmerman passed out fliers? Does the act of passing out fliers negate his actions on the night he shot Martin? No. However Zimmerman's lawyers and family wan to to spin this, they can't get away from the fact that Zimmerman profiled Martin the night he shot him based solely on his appearances. There is a 911 call with Zimmerman's voice describing Martin as, suspicious, like he's up to no good, like he's on drugs or something, [there's] something wrong with him. Based on the color of Martin's skin, the clothes Martin was wearing, and the way Martin was walking Zimmerman falsely judged Trayvon martin to be a criminal in the act of committing a crime. Then, In an attempt to help police stop the criminal threat, Zimmerman exits the vehicle and follows Martin to prevent the suspicious criminal from getting away, because according to Zimmerman, they always get away. That is the very picture of profiling, and this case Zimmerman profiled wrong. Was it purely racially motivated, who knows, but to think that race did not play a part is ridiculous. Say what you want to about either of their pasts, that is inconsequential, what matters is that prior to shooting Martin, Zimmerman falsely reports Martin as suspicious and calls him a criminal based on his own assumptions and the appearance of Martin. |

You are absolutely right that as a question of fact that both sides agree that Zimmerman killed him. That is certainly one less thing the prosecution has to prove. However, the mere act of killing someone is not in and of itself a crime. The state still needs to prove that Zimmerman unlawfully killed him.If we assume for a second a jury that used only logic and the law and the state only came in and proved that Zimmerman killed Trayvon and rested it's case without making an argument that it was an illegal killing, then that jury would declare Zimmerman innocent. Where I think you are going with this, and it is a good point, is that juries are people that use emotion and not just logic. The fact that there is no question that Zimmerman killed Trayvon means that Zimmerman may have a tougher job on defense to deal with the emotional factors around the fact that there is no question that he killed Trayvon.The smoking pot example is the same thing. Now that there are legal ways to have pot in your possession certain areas, in those areas the state now not only has to prove possession, but that the possession was not legal (all emotional jury factors aside).Thanks,Kevin |
